READ CAREFULLY BEFORE ORDERING THE SOFTWARE. LICENSE AGREEMENT This is a legal agreement between you (either an individual or an entity) and Acro Software Inc. By using or distributing Custom PDF Writer (hereinafter "the Software" or "Software"), you are agreeing to be bound by the terms of this agreement. LICENSE TO REPRODUCE, USE AND DISTRIBUTE Acro Software Inc. grants to you as an individual or entity a non-exclusive license to reproduce, use and distribute the SOFTWARE. The rights granted under this Agreement are only effective upon payment of license fees and possession of the appropriate License Agreement (if applicable). The software is licensed, not sold.   Custom PDF Writer needs to refer to GPL Ghostscript or other PS2PDF interpreter. GPL Ghostscript is an open-source interpreter for the PostScript language and the PDF file format. It is distributed under the GNU General Public License (NOT under this license agreement). You may obtain the source code for GPL Ghostscript here.   TERMS OF USE OR DISTRIBUTION You have a right to use or distribute the SOFTWARE only if: (a) You may not translate, modify, reverse engineer, decompile or dissemble the Software, except to the extent that this restriction is expressly prohibited by applicable law. (b) Your distribution of the software may not, in the reasonable opinion of Acro Software, compete with a Acro Software Inc. product.  (c) You do not use the Acro Software Inc. or CutePDF name, logo or trademark to market your distribution of the software. (d) You agree to indemnify, hold harmless, and defend Acro Software Inc. and its suppliers from and against any and all claims or lawsuits including attorney's fees that arise or result from the use of your distribution of the software. WARRANTY DISCLAIMERS AND LIABILITY LIMITATIONS The software, and any and all accompanying software, files, data and materials, are distributed and provided "AS IS". Acro Software disclaims any kind of warranties and conditions, whether express or implied, including the warranties of merchantability, fitness for a particular purpose and non-infringement of third party rights. In particular, Acro Software does not warrant that the operation of the software will meet your requirements or operate free from error. No oral or written information or advice given by Acro Software, its dealers, distributors, agents or employees shall create a warranty or in any way increase the scope of this warranty and you may not rely on any such information or advice. This disclaimer of warranty constitutes an essential part of this license. Any liability of Acro Software will be limited exclusively to refund of purchase price. Acro Software shall not be liable for any incidental or consequential damages (including damages for lost business profits, loss of information, business interruption, or the like) arising out of the use or distribution or inability to use the software even if Acro Software or its representative have been advised of the possibility of such damages. In addition, in no event shall Acro Software, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any indirect, incidental, consequential, or punitive damages whatsoever relating to the use or distribution of the software, or to your relationship with Acro Software. U.S. GOVERNMENT RESTRICTED RIGHTS The SOFTWARE and written materials are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, as applicable. Manufacturer is Acro Software Inc. This Agreement is governed by the laws of the State of Virginia, the U.S. Copyright Act and other applicable U.S. federal laws. All disputes or legal proceedings relating to use of the SOFTWARE or this Agreement shall be brought and heard exclusively in the state or federal courts located in York County, Virginia, and by installing and/or using the SOFTWARE, you hereby irrevocably consent and submit to personal jurisdiction in such courts for all such disputes or legal proceedings.
